These Terms of Service ("Terms") constitute a legally binding agreement between you and QT FM, owned and operated by QT FM STUDIOS ("we", "us", or "our"). These Terms govern your access to and use of the QT FM website (qtfm.co.uk), our audio streams, mobile software, and connected television applications, including the QT FM Roku Channel (collectively referred to as the "Service").

1. Scope of the Service

The Service provides live audio streaming, station schedules, metadata (including real-time track and presenter information), news updates, weather information, and community features. The Service is accessible across multiple platforms, including desktop browsers, mobile devices, and television streaming devices such as Roku.

2. Permitted Use & Public Performance Licensing

Personal & Domestic Use

Our digital streams, mobile apps, and Roku channel are provided solely for your personal, non-commercial, private domestic entertainment. You may not record, capture, rip, duplicate, redistribute, or rebroadcast any part of the audio stream or station content.

Commercial Premises & Public Broadcasts

If you stream QT FM in a commercial establishment, workplace, or public venue (such as a shop, salon, pub, club, restaurant, gym, or office), you must ensure your premises hold the requisite public performance licences.

3. Roku Channel & Connected TV Terms

When accessing QT FM via our channel on the Roku streaming platform, the following conditions apply alongside these general Terms:

• Platform Agreement: Your use of the Roku platform is subject to the Roku Terms of Use. Installing or accessing the QT FM channel on a Roku device requires compliance with both Roku's policies and these station Terms.
• Third-Party Platform Disclaimer: The QT FM Roku channel is published and maintained independently by QT FM STUDIOS. Roku, Inc. is not a sponsor, partner, or operator of QT FM, does not control our programming, and accepts no liability or responsibility for our broadcast audio, advertising, or metadata.
• Device Compatibility & Bandwidth: Continuous audio streaming consumes network bandwidth. You are responsible for ensuring your broadband connection and Wi-Fi equipment support audio streaming without incurring excess charges from your internet service provider (ISP).
• Channel Updates & Availability: We reserve the right to modify, patch, update, or withdraw the QT FM Roku channel (or any specific feature of the channel) at any time to preserve security, maintain platform compatibility, or comply with statutory requirements.

4. Intellectual Property & Broadcast Copyright

Station Branding & Design

All station marks, logos, trading names ("QT FM", "QT FM GOLD", and "QT FM STUDIOS"), website source code, visual layouts, station sweepers, jingles, and original editorial content are the exclusive intellectual property of QT FM STUDIOS. You may not reproduce, adapt, or distribute these assets without prior written consent.

Musical Works & Master Recordings

All sound recordings and musical compositions transmitted on QT FM are broadcast under relevant statutory broadcast licences. You do not acquire any ownership interest, publishing rights, or reproduction permissions in any music streamed through our website, mobile apps, or Roku channel.

5. Prohibited Conduct

When interacting with the website, our application interfaces, or our production studios, you agree that you will not:

• Employ automated systems, bots, scrapers, or extractors to intercept stream URLs, playlists, or database content.
• Interfere with, overload, flood, or compromise our hosting servers, proxy endpoints, or streaming architecture.
• Transmit offensive, defamatory, abusive, threatening, or unlawful submissions via studio contact forms, text lines, or message boards.
• Attempt to bypass, disable, or tamper with digital rights management, stream proxies, or ad-serving systems.

6. Third-Party Feeds & Advertising

Our services feature dynamic feeds and outbound links, including:

• Information Feeds: Real-time headlines, sports results, and weather forecasts supplied by external syndicate providers (such as BBC RSS feeds and Open-Meteo). We do not author or verify third-party feeds and cannot warrant their real-time accuracy.
• Commercial Affiliates: Commercial links and affiliate promotions (such as referral links to rewards programmes). Any purchases or registrations made through external merchant websites are governed entirely by those third parties' commercial terms.

7. Service Availability & "As Is" Provision

We endeavour to keep QT FM broadcasting 24 hours a day, 7 days a week. However, live transmissions, network servers, and third-party delivery networks (including cloud infrastructure and CDN providers) occasionally experience maintenance outages, carrier drops, or technical faults. The Service is provided on an "as is" and "as available" basis without guarantees of continuous, uninterrupted transmission.

8. Limitation of Liability

To the fullest extent permitted by law, QT FM STUDIOS, its directors, broadcast personnel, contractors, and affiliates shall not be liable for any indirect, incidental, special, or consequential losses, including lost data, broadband overage charges, or hardware faults arising from your use of or inability to access our streams, websites, or Roku channels.

9. Competitions & Promotions

On-air and online competitions or prize giveaways will be subject to supplementary promotional rules published at the time of launch. Where any conflict arises between general station terms and competition-specific rules, the promotional rules take precedence for that competition.

10. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms, our website, or our broadcasting applications shall be subject to the exclusive jurisdiction of the courts of England and Wales.
